Terms of Service

1. Acceptance of Terms

Welcome to Fund My Squad. These Terms of Service ("Terms") govern your access to and use of the Fund My Squad website, mobile application, and related services (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms.

If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Fund My Squad is a fundraising platform designed for youth sports organizations, teams, and individual athletes. The Platform enables:

• Creation and management of fundraising campaigns
• Collection of one-time and recurring donations
• Team and participant management
• Communication tools for organizers and donors
• Payment processing and payout management via Stripe

3. Eligibility

To use the Platform, you must:

• Be at least 18 years old, or have parental/guardian consent if under 18
• Be a resident of the United States
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Not have been previously suspended or removed from the Platform

Geographic Availability: Fund My Squad is currently available only to organizations and individuals located in the United States. Only US-based organizations may create fundraising accounts, and only US-based payment methods may be used to process donations. We do not accept fundraiser registrations or facilitate payments from outside the United States.

Minors participating in fundraising activities must have a parent or guardian manage their account and provide consent for their participation.

4. Account Registration

You must create an account to access certain features of the Platform. You agree to:

• Provide accurate, current, and complete information during registration
• Update your information to keep it accurate and current
• Keep your password confidential and secure
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

5. Fundraiser Guidelines

5.1 Permitted Use

Fundraisers on the Platform must be for legitimate youth sports purposes, including:

• Team equipment, uniforms, and supplies
• Travel expenses for competitions and tournaments
• Registration fees and league dues
• Facility rentals and training costs
• Scholarships for athletes in need
• Other sports-related expenses

5.2 Prohibited Activities

You may not use the Platform to:

• Raise funds for illegal activities or purposes
• Engage in fraud, misrepresentation, or deceptive practices
• Collect funds for personal use unrelated to stated fundraising goals
• Engage in money laundering, terrorist financing, sanctions evasion, or other financial crimes
• Transact with or on behalf of individuals, entities, or jurisdictions subject to economic sanctions
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Harass, abuse, or harm other users
• Post content that is obscene, defamatory, or discriminatory
• Attempt to circumvent Platform fees, payment processing, or compliance controls

5.3 Organizer Responsibilities

As a fundraiser organizer, you agree to:

• Provide accurate information about your fundraising campaign
• Use donated funds only for the stated purposes
• Respond to donor inquiries in a timely manner
• Comply with all applicable tax and reporting requirements
• Maintain appropriate records of fund usage

6. Compliance, Verification & Risk Controls

6.1 Acceptable Use Policy

All use of the Platform is subject to our Acceptable Use Policy, which prohibits fundraising for activities on Stripe's Prohibited and Restricted Businesses list and other prohibited activities. The AUP is incorporated into these Terms by reference.

6.2 Identity Verification

To maintain the integrity and safety of the Platform, we require identity verification at multiple levels:

• Email verification: all users must verify their email address during registration
• Organizer verification (KYC): campaign organizers must complete Stripe Connect onboarding, which includes government-issued ID, address, and banking verification, before receiving any payouts
• Organization verification (KYB): organizations must provide their legal name, type, address, tax ID, and primary contact information, and must be approved by Fund My Squad before operating on the Platform
• Sanctions screening: all users, organizations, and donors are screened against the OFAC Specially Designated Nationals (SDN) list and other applicable sanctions lists

6.3 Campaign Risk Rating & Review

Every campaign is automatically assigned a risk rating (low, medium, or high) based on factors including goal amount, organizer history, organization verification status, and campaign type. Campaigns rated as high risk are held for manual review by Fund My Squad administrators and will not go live until approved. Fund My Squad reserves the right to review, hold, or reject any campaign at its sole discretion.

6.4 Transaction Monitoring

All transactions on the Platform are subject to automated monitoring for indicators of fraud, money laundering, terrorist financing, and other suspicious activity. This includes velocity checks, pattern analysis, and amount-based screening. If suspicious activity is detected, Fund My Squad may:

• Hold, delay, or reverse transactions
• Suspend or terminate accounts
• File Suspicious Activity Reports (SARs) with relevant authorities
• Report activity to law enforcement

6.5 Prohibited Jurisdictions

Fund My Squad operates exclusively within the United States. Fundraiser accounts may only be opened by US-based organizations and individuals, and donations may only be made using US-based payment methods. We do not facilitate cross-border fundraising or accept payments originating from outside the United States.

Additionally, Fund My Squad does not permit transactions to, from, or in support of causes in jurisdictions subject to comprehensive sanctions by the U.S. Office of Foreign Assets Control (OFAC), the European Union, or the United Nations Security Council. Transactions involving prohibited jurisdictions will be blocked or automatically refunded.

6.6 Cooperation with Authorities

Fund My Squad cooperates with law enforcement and regulatory authorities as required by applicable law. We may disclose user information, transaction records, and other data in response to valid legal process or when we believe in good faith that disclosure is necessary to prevent financial crime, protect the safety of any person, or comply with applicable law.

7. Donations and Payments

7.1 Donation Processing

All donations are processed in US dollars through Stripe, our third-party payment processor. Donations may only be made using US-based payment methods. By making a donation, you agree to Stripe's terms of service. Donations are generally non-refundable except in cases of fraud, sanctions violations, or at our sole discretion. Donations involving prohibited jurisdictions or sanctioned parties may be automatically refunded.

7.2 Recurring Donations

If you set up a recurring donation, your payment method will be charged automatically on a monthly basis until you cancel. You may cancel, pause, or modify your recurring donation at any time through your account settings.

7.3 Fees

Fund My Squad charges a platform fee on donations (currently 5%). Additionally, standard payment processing fees apply (2.9% + $0.30 for card payments, 0.8% capped at $5 for ACH). Fee details are displayed transparently before completing a donation. Donors may choose to cover processing fees.

7.4 Payouts

Fundraiser organizers receive payouts in US dollars to US bank accounts through Stripe Connect. You must complete Stripe's identity verification process (KYC/KYB), including providing government-issued ID, US address, and US banking details, before receiving any funds. Payout timing depends on your Stripe account settings and may be subject to holds for new accounts or campaigns flagged for review.

8. Content and Intellectual Property

8.1 Your Content

You retain ownership of content you submit to the Platform (photos, descriptions, messages). By posting content, you grant Fund My Squad a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Platform.

8.2 Content Standards

All content must comply with our content guidelines. We reserve the right to:

• Review and moderate content before or after publication
• Remove content that violates these Terms
• Suspend or terminate accounts for repeated violations

8.3 Platform Intellectual Property

The Platform, including its design, features, and content created by Fund My Squad, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute Platform materials without our written permission.

9. Communications

By using the Platform, you consent to receive communications from us, including:

• Transactional emails (account verification, donation receipts, payout notifications)
• SMS messages for invitations and reminders (if you provide a phone number)
• Push notifications (if enabled on your device)
• Marketing communications (with your consent)

You may opt out of marketing communications at any time. Reply STOP to any SMS to unsubscribe from text messages. Transactional communications are required for Platform functionality and cannot be disabled.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The Platform will be uninterrupted, secure, or error-free
• Any fundraiser will reach its goal
• Funds raised will be used as represented by organizers
• Information provided by users is accurate or complete

Fund My Squad is a platform that facilitates fundraising but does not guarantee the legitimacy of any fundraiser. Donors should exercise their own judgment when making contributions.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUND MY SQUAD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, OR (B) $100.

13. Indemnification

You agree to indemnify and hold harmless Fund My Squad and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Platform
• Your fundraising activities

14. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination:

• Your right to use the Platform will immediately cease
• Active fundraisers may be closed
• Pending payouts will be processed according to our policies
• We may retain certain information as required by law

You may delete your account at any time through your account settings or by contacting us.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction for violations of intellectual property rights.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Fund My Squad regarding your use of the Platform and supersede any prior agreements.
